Welcome to HealthHill: Blood Sugar & Blood Pressure (hereinafter referred to as "the App"). The App is developed and provided by us. These Terms of Use (hereinafter referred to as "Terms") constitute a legally binding agreement between you (hereinafter referred to as "User") and us regarding your use of the App. Please read and fully understand all contents of these Terms before downloading, installing, or using the App. By clicking "Agree," downloading and installing, or actually using the App, you indicate that you have fully accepted these Terms and are willing to be bound by them. If you are a minor (generally under 18 years of age according to the laws of your region), please read these Terms with the accompaniment of your legal guardian and use the App only after obtaining explicit consent from your legal guardian.
1. Rules for Using the App
1.1 Scope of Use and Permissions
You may only use the App for personal, non-commercial health data recording and reference purposes, and may not use it for any commercial purposes (including but not limited to embedding the App's functions into commercial products or commercially selling data obtained through the App). We grant you a non-exclusive, non-transferable, limited license to use the App only. You may not transfer this license to any third party without our written permission.
1.2 Prohibited Abusive Behaviors
During your use of the App, you agree to comply with the following regulations and not engage in any abusive behavior:
- You must not access or modify the source code, backend systems, or related data storage modules of the App without authorization;
- You must not interfere with the normal operation of the App or bypass its functional limitations through plugins, scripts, crawlers, or other technical means;
- You must not use the App to disseminate illegal, harmful, false, or harassing content, or engage in behaviors that infringe upon the privacy, intellectual property rights, or other legitimate rights and interests of others;
- You must not use the App for any activities that violate the laws and regulations or public order and good customs of your region.
2. Health Disclaimer (Important)
2.1 Nature of the App
The App is solely a health data recording and reference tool and is not a medical device. It does not possess medical diagnosis, treatment, or health intervention functions. The heart rate, blood sugar, and blood pressure data recording, trend analysis, and other functions provided by the App are intended only to help you understand your health status for reference purposes and cannot replace professional medical advice.
2.2 Medical Liability Exemption
- You acknowledge that: the measurement results of the App (such as heart rate data obtained through device sensors) may be affected by factors such as measurement environment, operating methods, and device status, and may have certain errors. They cannot be used as a basis for medical diagnosis;
- If you have any health concerns (such as abnormal heart rate, abnormal blood sugar/blood pressure indicators) or need to obtain medical advice, diagnosis, or treatment plans, you must promptly consult licensed healthcare professionals (such as doctors, nurses, nutritionists, etc.) and must not rely on the App's data to make your own judgments or take medical actions;
3. Data Processing and User Responsibilities
3.1 Data Storage and Control
- Heart rate, blood sugar, blood pressure, and other health data you record through the App, as well as manually entered related information, are stored only on your device locally. We will not collect, store, use, or share your health data and personal information in any form (including cloud synchronization, server upload, third-party transmission, etc.);
- You have complete control over your own data and can view, edit, or delete individual/all data through the "Data Management" function within the App. If you uninstall the App, all data related to the App stored on your device will be completely removed.
3.2 User Data Management Responsibilities
- Please properly safeguard your device and app access permissions to prevent unauthorized viewing or modification of your health data by others. If your device is lost, stolen, or faces a data leakage risk, please take timely measures such as device locking or data clearing. We are not responsible for data security issues caused by your own improper safekeeping;
- You promise that the health data you enter when using the App is true and accurate. You shall bear the consequences of any health reference deviations or other consequences caused by false data.
4. Intellectual Property Protection
4.1 Ownership of Intellectual Property
All contents and functions of the App (including but not limited to application code, interface design, icons, text descriptions, data visualization templates, functional algorithms, etc.), except for the health data you enter yourself, belong to the legal licensor.
4.2 Usage Restrictions
Without our written permission, you must not:
- Copy, modify, adapt, translate any part of the App, or create derivative works;
- Reverse engineer, decompile, or disassemble the App, or attempt to obtain the source code of the App;
- Distribute, disseminate, rent, or sell the App without authorization, or enable third parties to obtain access to the App in any way;
- Infringe upon the trademark rights, patent rights, copyrights, and other intellectual property rights involved in the App, or use marks or designs similar to the App, causing user confusion.
5. Service Termination and Limitation of Liability
5.1 Service Termination Circumstances
- If you violate any provision of these Terms (such as engaging in abusive behavior, infringing intellectual property rights, violating health disclaimer-related provisions, etc.), we have the right to suspend or terminate your access to the App without prior notice and without assuming any liability for compensation;
- You may terminate your use of the App at any time by uninstalling it. If we need to terminate the provision of App services due to business adjustments, technical upgrades, or other reasons, we will notify you 30 days in advance through in-app notifications, official emails, or other means, and provide you with a reasonable period to export your data.
5.2 Limitation of Liability
- The App is provided "as is," and we make no express or implied warranties regarding the availability, stability, accuracy, or error-free operation of the App (including but not limited to warranties of merchantability, fitness for a particular purpose, etc.);
- To the extent permitted by law, we are not liable for losses caused by the following circumstances: ① The App is unable to operate normally due to technical failures, network issues, device compatibility, or other reasons; ② Losses you incur due to violations of these Terms or misuse of the App; ③ Losses caused by illegal attacks or tampering with the App by third parties;
- Our maximum liability for compensation to you (if any) shall not exceed the fees you have paid to use the App (if you are using a free version, the liability for compensation is zero), and does not include indirect losses, incidental losses, expected profit losses, or other non-direct losses.
6. Changes to Terms and Notifications
6.1 Right to Revise Terms
We have the right to revise these Terms from time to time based on updates to laws and regulations, business development needs, app function adjustments, and other circumstances. The revised Terms will replace the original Terms and become the effective agreement between you and us.
6.2 Method of Change Notification
When these Terms are changed, we will update the "Effective Date" above. Please check regularly.
6.3 User Acceptance Method
Your continued use of the App after changes to the Terms indicates that you have read, understood, and accepted the revised Terms. If you do not agree with the revised Terms, you should immediately stop using the App and uninstall the application.
